4th man arrested, accused of torturing roommate

JEFFERSON COUNTY, Colo. — A fourth man is in custody and faces charges including attempted murder for his suspected role in the kidnapping and torturing of a roommate, the Jefferson County Sherriff's Office said on Wednesday.

Jimmy Ray Smith II, 39, was tracked down at a Denver pizza shop on Monday where he was taken into custody by Denver Police without incident. He is being held on suspicion of charges including first-degree attempted murder, second-degree kidnapping, first- and second-degree assault, and crime of violence with a weapon.

Smith is the last of four suspects arrested in connection with an assault that occurred Sept. 15 in the 4700 block of South Oak Court, near South Simms Street and West Belleview Avenue.

The sheriff's office was notified about the assault the next day when a hospital staff member reported that a patient claimed he had been tied up and tortured for 14 hours.

According to arrest warrants, the incident started around 2 a.m. Sept. 15 when the victim was in a basement room belonging to another roommate. He heard three other men in the house talking about beating him up, the warrants say. When the victim heard this, he called his sister and told her they needed to leave the house, where she also lived. 

The victim then tried to crawl out a bedroom window, but when he couldn't, he barricaded himself in the bedroom. A short time later, three men broke into the room, shot the victim with rock salt from an airsoft-type firearm, and began assaulting him, stated the arrest warrants.

The 45-year-old victim sustained injuries from being tied up, beaten, burned, whipped and having his neck stepped on. Another person in the house who was not involved in the torture was able to help the victim get out of the house and to the hospital, the sheriff's office said.

Three men were arrested the same day the incident was reported. They were 49-year-old Jason Carlson, the homeowner; Sherell Allen, 48, and Luke Anaya, 41.

They each face the following charges:

  • Attempted first-degree murder
  • Second-degree kidnapping
  • First-degree assault
  • Second-degree assault

Smith is being held on a $500,000 cash-only bond and is scheduled to appear in court on Thursday.
