ADAMS COUNTY, Colo. — A former charter school teacher who pleaded guilty to two felony charges in April was sentenced Tuesday in Adams County.
John McMillan pleaded guilty to:
- Child abuse - negligently causing serious bodily injury
- Attempted sex assault on a child by one in a position of trust - victim between 15-18 years old
Two other felony charges were dismissed as part of the plea deal. A judge sentenced McMillan to four years of probation and 30 days of work release.
McMillan taught at Landmark Academy, a charter school in Reunion, from 2011 until the end of the 2022 school year, Commerce City Police said in a news release on McMillan's arrest last year.
McMillan also taught at Fort Lupton Middle School, police said.
The arrest affidavit said McMillan was accused of having sexual contact with a student at Landmark Academy between Aug. 1, 2021 and May 31, 2022.
McMillan's wife found emails between McMillan and a then-12-year-old student that appeared to be sexual in nature and reported them to her therapist and Child Protective Services, the affidavit said.
The victim was contacted and reported that McMillan had commented about her beauty by calling her "good-looking" and "sexy," the affidavit said. She also reported that the two had exchanged photos.
The victim disclosed that McMillan grabbed her butt on more than five occasions and during one of those interactions stated, "have a nice day, sexy," according to the affidavit.
