AURORA, Colo. — Three different women say the owner of an Aurora drug testing business sexually assaulted them when they went to the business for drug testing, an arrest affidavit says.
Arben "Ben" Duka, 60, was arrested on March 15 in connection with one of the assaults. He's since been charged in a second incident.
According to the arrest affidavit from the Aurora Police Department, a woman reported that she was assaulted at his business, Aurora Employment Testing, at 1701 Chambers Road, Suite E on Oct. 26. She claimed that she went to the business for a drug test and that as she was giving a urine sample, the business owner, later identified as Duka, entered the bathroom with her and said he needed to watch her provide the sample, the affidavit says.
She said she told Duka she was uncomfortable with that, and Duka approached her and attempted to pull her pants down. She then said that Duka claimed he had to do an "examination" and tried to corral her into a room, according to the affidavit.
The victim said Duka hugged her, asked if she was single, and told her to call him if she ever wanted a date before he allowed her to leave, the document says.
Police contacted Duka and he told them that the woman provided him with a different container than she was supposed to and that he suspected she had provided him with a "false sample," the affidavit says. He explained that when he suspects a false urine sample was provided, he takes the person to another room for a mouth swab.
He claimed he did that with the woman, but she became upset, refused to do the mouth swab and left the business claiming he was trying to "ruin" her, the affidavit says. When asked if he ever stayed in the bathroom when samples were provided, Duka responded that he always waits outside.
While investigating her case, police noted there were two prior calls to Duka's business.
One of the other victims reported on Oct. 10 that Duka sexually assaulted her after she provided a urine sample, the affidavit says. The investigators noted the claims in her report were very similar to the latest incident.
She also claimed that Duka insisted on watching her provide the sample and that he corraled her into a room after providing her with a receipt, the affidavit says.
The woman said during the assault Duka kissed her against her will. She said her sister called during the attack and when her phone rang, it startled Duka. Investigators noticed the time stamp on her receipt was 1:32 p.m. and she missed a call at 1:39 p.m.
When Duka was later asked about the woman's visit, he said nothing "extraordinary" happened during the appointment and the woman was there for less than 10 minutes.
In a third case, a woman reported that Duka had attempted to block her exit after she provided a sample and said he hugged and tried to kiss her on the lips.
Duka is currently charged in the Oct. 10 and Oct. 27 incidents, according to court records. He's due in court on April 8.
Duka changed the name of his business last year, police said. From 2015 to 2023, Duka's business operated under the name Wiz Quiz Employment Testing.

Denver defense attorney Colin Bresee told 9NEWS he is representing Duka in one of the cases. He said there are some legal issues around one of the victim's claims. He said he was not provided DNA evidence that could confirm a sexual assault had occurred.
Duka is currently out on a $10,000 bond.
