Douglas County man convicted for taking part in riot at U.S. Capitol

Patrick Montgomery and two Utah men are scheduled to be sentenced on July 2.

WASHINGTON — A Douglas County man was convicted of two felonies by a federal judge on Wednesday for taking part in the riot at the U.S. Capitol on Jan. 6, 2021.

Patrick Montgomery was convicted of:

  • Obstruction of an official proceeding
  • Assaulting, resisting or impeding certain officers

According to the stipulated facts in the case, Montgomery and two men from Utah met on the morning of Jan. 6 at a hotel in Washington. The men walked to an area near the Washington Monument and the Ellipse to listen to the speakers at the "Stop the Steal" rally, the criminal complaint states.

Once the rally ended, the three men walked to the West Front of the Capitol building.

Just after 2 p.m., Montgomery grabbed a law enforcement officer's baton and tried to wrestle it away, the complaint says. The officer and Montgomery fell to the ground while they wrestled for the baton, according to the complaint. During the tussle, Montgomery kicked the officer in the chest, the complaint says.

After the scuffle, Montgomery and the two Utah men went up the Upper West Terrace stairs with the rest of the growing mob, the complaint says. The men entered the Capitol at approximately at 2:35 p.m.

The men entered the Senate gallery a little before 2:45 p.m., the complaint states. The men then left the Senate Gallery and went to the second floor near the Senate Floor, confronting a U.S. Capitol Police officer, the complaint says. Montgomery yelled, "You gotta stop doing your job sometime and start being American. You gotta quit doing your job and be an American!”

The men exited the Capitol at 2:53 p.m.

The FBI said three people left tips for them on Jan. 7 identifying Montgomery.

Montgomery and the two Utah men are scheduled to be sentenced on July 2.
