Charges filed against suspect involved in Commerce City crash that injured 4 first responders

Benjamin Winters is charged with vehicular assault and third-degree assault in the crash Dec. 7.

BRIGHTON, Colo. — The Adams County district attorney's said Wednesday that they have filed charges against a man accused of hitting and injuring four first responders in Commerce City on Dec. 7.

Benjamin Winters is charged with two counts of vehicular assault and three counts of third-degree assault, according to the 17th Judicial District Attorney's Office. Winters was arrested on Dec. 8, according to jail records.

The crash happened about 9:10 p.m. Dec. 7 on Interstate 76 near Sable Boulevard in Commerce City, according to police.

Commerce City Police Department officers and South Adams County firefighters were outside their vehicles investigating a separate, single-vehicle crash in the westbound lanes when they were hit.

A firetruck was blocking both westbound lanes for traffic control and allowing cars to pass on the right shoulder. The driver of a Toyota Tacoma drove around the firetruck on the left shoulder, reentered the roadway and hit the officers and firefighters, who were in the left lane near a patrol car, according to Colorado State Patrol.

The driver continued on before coming to a stop on the left shoulder. He was taken into custody and booked into the Adams County jail. On Friday, the suspect was identified as Winters.

Winters is scheduled to be in Adams County Court at 1:30 p.m. Wednesday, according to the court docket.
