COMMERCE CITY, Colo. — A man accused of shooting a man who had tracked down his friend's stolen vehicle was identified as a suspect in part because his wallet was found on the ground at the crime scene, according to an affidavit for his arrest from Commerce City Police.
Enrique Macial faces charges of attempted murder and motor vehicle theft after the Jan. 10 shooting in the 5400 block of Krameria Street.
According to the affidavit, three people, including the shooting victim, went to that area after a GPS placed a stolen red truck belonging to one of them at that location. The red truck, which was reported stolen to Denver Police earlier that same day, was sitting on the side of the road with a black truck in front of it.
The three people parked behind the red truck to block it in, the affidavit says. The victim and others then got out and approached the driver of the red truck. As they did, the driver of the black truck got out and started shooting. The victim was shot twice, once in his right thigh and once in his left thigh, the affidavit says. No one else was hit.
After the shooting, the suspect got into the passenger side of the red truck, and the driver backed into the victim's car before driving away from the area.
The black truck, which had been reported stolen to the Aurora Police Department on Jan. 6, was left at the scene. Investigators found a wallet on the ground directly underneath the driver's side door. It contained a Colorado driver's license belonging to Macial, according to the affidavit. Several 9mm shell casings were also found near the truck.
Investigators showed the three men a photo array, and one of them picked out two photos they believed to be the suspect, the affidavit says. He said the men looked similar and he could not be certain. One of the photos he selected was Macial, according to the document.
The owner of the red truck agreed to provide his cellphone to the police so they could track the vehicle using the GPS system attached to it. Investigators located the truck near East 17th Avenue and Macon Street in Aurora. After a short pursuit, it was stopped in the 9700 block of East 33rd Avenue, the affidavit says. A woman passenger was taken into custody without incident. Macial ran away but was arrested after a short foot chase.
He voluntarily spoke with investigators and, according to the affidavit, denied ever being in the black truck. He said he was in the 5400 block of Krameria Street to meet another friend and said his head was down and he didn't notice another car pull up. When he looked up, he said he saw three men approaching the red truck, which was occupied by his brother-in-law.
According to the affidavit, Macial refused to name his brother-in-law and repeatedly stated he needed to protect his "family." He went on to say, according to the document, that he couldn't remember what happened after the men approached but said he was "adamant" his brother-in-law did not shoot a gun. He would not admit or deny that he did the shooting.
He is next due in court on Feb. 9 for a preliminary hearing.
