Woman injured after being hit by suspect running from police

Despite police catching the suspect after the crash, the person has not been arrested.

FREDERICK, Colorado — A Frederick woman is lucky to be alive after she was reportedly hit by a driver running from the police.

The crash happened on July 11 near Highway 52 and Colorado Boulevard in Frederick last month. Heather Partida told 9NEWS she was turning onto Colorado Boulevard from Highway 52 when she was hit. 

A Frederick Police officer was chasing a suspect in a stolen car, but the officer bailed on the chase as the suspect started driving dangerously, according to the incident report. However, the officer observed that the suspect kept going and eventually slammed into Partida's car, going an estimated 50 to 60 miles an hour. 

"Luckily, I didn't really break anything," Partida said with relief. "Now it's just trying to get the whiplash and the concussion to heal and go away because my head has not stopped hurting since the accident."

Partida said she's going to be okay, but Frederick Police have yet to arrest the suspect. 

"It kind of leaves me lost for words," Partida said. "Honestly, it makes me disgusted."

According to the report, the suspected driver and his passenger, who has four active warrants out from four agencies, were both taken to the hospital and then released without getting arrested. 

"To learn that they’re just out, you know, doing whatever it is that they want, I find it disgusting because what would it take? For them to kill me?" Partida questioned. "They're going to, more than likely, end up killing someone."

Frederick Police would not respond to 9NEWS' requests for an interview, but they did send a statement saying both occupants were transported to the hospital, so they weren't in police custody or arrested. 

"Unless officers remain at the hospital for the duration of care, a warrant allows the officer to lawfully arrest the suspect at a future time and location," they added. 

"Why are we depending on warrants? So that we can end up using more man force out there trying to recapture him again? This whole thing happened because they were trying to capture him and because they were chasing him," Partida said.  "Had that not been going on, I probably would have never even been hit."

Being hit started a sequence of unfortunately events for Partida. 

After falling on hard times, a friend had gifted her that car just a few months ago. She could only afford liability insurance at the time, which means her car, which was totaled, was not covered.

Partida had also just started a new job, so she didn't have health insurance at the time either. Her daughter created a GoFundMe to help with all the bills.  

"It makes me angry just to know that they have gone back to their lives like nothing ever happened when I don't get to do that," Partida said. "This whole entire situation and the choices that [the suspects] were making were just really stupid on their part." 

Police believe the driver hit two other cars before the pursuit even started. 

According to the Weld County District Attorney's Office, the warrants are still active, and the Colorado Bureau of Investigations database shows the two have not been arrested in Colorado. 

9NEWS asked the police department why officers did not remain at the hospital and if there's a specific threshold or charge that would have kept them there, but the department has not responded as of Friday evening.
