DENVER (AP) - A Denver District Court judge has dismissed the charges against two men who were accused of jury tampering after handing out jury nullification literature on courthouse grounds.
The Denver Post reports that the judge on Wednesday dismissed seven counts of jury tampering levied against Mark Iannicelli and Eric Brandt.
The men were arrested in July for handing out jury nullification pamphlets to potential jurors. A U.S. District Judge later ruled the pamphlets were protected speech and that the men had the right to distribute them on courthouse grounds.
A district attorney's office spokeswoman says prosecutors are weighing their options for appealing the criminal ruling. She says the District Attorney supports the First Amendment, but is obligated to uphold Colorado law, which bans a person from communicating with a juror to influence their vote.
