DENVER — While video shows a gaping hole in a moving walkway just before a pilot’s foot nearly got mangled, the company responsible for maintenance is denying responsibility.
In January, 9NEWS reported on Kenneth Gow’s lawsuit that includes video of the incident that occurred in 2022. The video shows a missing comb plate at the end of the walkway moments before the open slot caught Gow’s foot, leading to a fall and a mangled shoe.
Gow has a pending lawsuit against TK Elevator and is seeking damages after claiming the incident caused injuries to his foot and body.
In a written response to Gow’s complaint, attorneys for TK Elevator assert the company is not responsible for injuries and that a “third party” could be to blame.
“The accident and/or the claimed damages were caused in whole or in part by independent intervening causes or forces, or a third party, over which the Defendant has no control,” an attorney for TK Elevator wrote.
In the court document, TK Elevator admits it is responsible for maintaining the walkway; however, their response did not include an explanation as to what caused a comb plate at the end of the walkway to go missing.
Attorneys also hinted in their response that Gow himself could be responsible for the incident.
The video does show Gow looking down at what appears to be a cellphone as his foot gets stuck, but the attorney for TK Elevator was not specific in how Gow could be responsible.
“The injuries and damages sustained by Plaintiff, if any, may have been the direct result of the comparative negligence of Plaintiff,” the attorney’s wrote.
A trial date has not been set in the case.
