Weld County DA: No charges filed against deputies following man's in-custody death

WELD COUNTY, Colo. — The Weld County District Attorney’s Office will not file criminal charges against several deputies involved in a physical altercation with a man who stopped breathing and died a short time later, the DA's office announced Wednesday. 

On Feb. 23, deputies were called to a home in the 4700 block of Everglade Court in unincorporated Weld County just before 2 a.m. in reference for an unwanted person, according to the Weld County Sheriff's Office. 

When they got on scene at 1:49 a.m., a physical altercation ignited between the deputies and Isaias Rodriguez, 33, of Greeley.

Rodriguez stopped breathing during the scuffle, and despite life-saving efforts by emergency medical staff, he was pronounced dead at the scene, deputies said.

An autopsy for Rodriguez showed that his cause of death was from fatal cardiac arrhythmia while under the influence of cocaine. 

“Based on the thorough investigation, DA Rourke has determined that the Weld County deputies who were involved in the incident, and who attempted to bring Rodriguez into compliance with their lawful commands, will not be charged,” the release reads.
