Three of the four people indicted in a planned marijuana robbery turned deadly shooting in Denver have pleaded guilty to a lesser charge of aggravated robbery.
Seth Michael Binns, 24; Ryan Arellano, 25 and Mackenzie Fay were all originally charged with felony murder and aggravated robbery in connection to the killing of 50-year-old Charles Polzin in November 2016.
According to the indictment, Binns, Arellano and Fay -- along with 34-year-old Joshua Binns -- planned to rob Polzin, who was selling a large amount of marijuana.
On Nov. 8, 2016, Charles Polzin, his son and his son’s girlfriend drove from Loveland to Denver to meet Joshua Binns for the sale, the indictment read. At the arranged time and place of the sale, Joshua Binns allegedly shot both Charles Polzin and his son, killing Polzin senior and seriously wounding the son.
Joshua Binns is charged with two counts of first-degree murder, felony murder, first-degree assault-deadly weapon, two counts of aggravated robbery, and one count of possession of a weapon by a previous offender.
Joshua Binns is scheduled for a disposition/motions hearing on Friday.
Seth Binns, Arellano and Fay are scheduled to be sentenced on April 20. The trio all face stipulated prison sentences of 16 and 32 years.
