No charges expected after 2 fatally shot at southwest Denver construction site

The worker got in a confrontation with two people who were not authorized to be in the building, Denver police said previously.

DENVER — No charges are expected to be filed after two people were killed in a shooting at a construction site in southwest Denver late last month.

A spokesperson for the Denver District Attorney's Office said Wednesday they do not plan to file any charges in connection with the shooting, which happened at a commercial construction site near Belleview Avenue and Wadsworth Boulevard around 1:30 p.m. Feb. 25. 

According to Denver Police, the site manager arrived at the site and found two unauthorized people inside, possibly burglarizing the business. There was some type of confrontation between the three of them and during it, the worker was assaulted, police said.

The manager then pulled out a gun and shot them both, according to police. 

Timothy Walker, 40, was shot multiple times and died at the scene, according to police. Patience McFall, 37, was shot once and died from her injuries.

Police said the site manager remained on the scene and cooperated with the investigation.

9NEWS legal analyst Scott Robinson said Colorado's "make my day" law -- which allows people to use deadly force inside their own homes -- would not apply in this case.

"The reality is that this is going to be a case in which self-defense will decide whether it's chargeable or prosecutable," Robinson said. "If the individual who fired the shots had a reasonable belief that he was in imminent danger of serious bodily injury or death, then then and only then can he use deadly force."
