Man charged in fentanyl death case pleads guilty to drug possession

A charge of distribution of fentanyl resulting in death was dismissed as part of the plea agreement, according to court records.

ADAMS COUNTY, Colo — A man who was charged in connection with a fentanyl overdose death pleaded guilty Tuesday to drug possession, according to court records. 

Milo Gonzales, 41, pleaded guilty to one count of possession of a controlled substance, according to court records. He was sentenced to 18 months probation. A charge of distribution of fentanyl resulting in death was dismissed as part of the plea agreement, according to court records. 

This was the first time the 17th Judicial District Attorney's Office, which covers Adams and Broomfield counties, had filed a distribution of fentanyl resulting in death charge. Prosecutors said at the time that Gonzales supplied the drugs that killed a 24-year-old man in Aurora on Feb. 3.

District attorneys during the 2022 legislative session asked state lawmakers for a new statute so they could charge someone for distributing fentanyl that killed a person. Federal prosecutors had already been able to charge someone for distributing fentanyl resulting in death, but before the law took effect in July 2022, that statute was not available to state prosecutors.
