No charges after fatal Brighton crash, investigation ongoing

BRIGHTON, Colo. — Prosecutors said on Wednesday they're declining to file charges at this time related to a deadly crash late last month in Brighton.

A 25-year-old male driver was arrested on a vehicular homicide charge after hitting a man who had just gotten out of the SUV early Saturday morning, the Brighton Police Department said.

Police said it happened around 2:45 a.m. Saturday on Southern Street near the intersection with South 50th Avenue. Police said the man was driving a Chevrolet Tahoe when a 50-year-old man got out of the SUV and then was hit by it, police said. He died on the scene. His name has not yet been released.

The driver was booked on charges including vehicular homicide and driving under the influence. Formal charges were expected Tuesday, but a spokesman for the 17 Judicial District Attorney's Office said charges were not being filed "pending further investigation."

9NEWS is no longer naming the man because he is not charged at this time.
