LONGMONT, Colo. — A man accused of shooting the mother of his children – while those two children were in the back seat of the vehicle – had a protection order in place that prohibited him from possessing a weapon, according to court documents.
Brandon Allen, 45, is accused of shooting the woman in the driveway of her Longmont home near East Mountain View and Deerwood Drive around 1:30 p.m. March 20. According to an arrest affidavit from Longmont Police, multiple neighbors heard gunshots and heard children yelling.
One witness said she heard a single shot and got up to look out her window. She saw a man standing by the passenger side of a vehicle in a driveway, the affidavit says. She said she saw the man shoot into the vehicle a second time and drive away in a white vehicle.
The victim was taken to the hospital for treatment of two gunshot wounds.
Investigators interviewed her children, who reported that they were in the back seat of their vehicle, about to go to the store, when their dad came up and shot their mom twice, the affidavit says. The children were not physically injured.
Once their dad left, one of the children rolled down a window and yelled for someone to call 911. One of them also said that their dad was "evil."
As officers searched for Allen, he called 911 and said, "I think I just killed my ex-wife" the affidavit says. He went on to say, according to the document, that he "fired a gun at her."
He was later found in his vehicle on Highway 36 in Lyons, but as officers made a plan to arrest him, he drove away, the affidavit says. Officers pursued him and, at one point during the chase, he fired shots, the affidavit says.
They eventually got him to stop near Hygiene after using several "pit maneuvers." Once Allen got out of his vehicle, he failed to comply with commands. The affidavit says a K9 was used to assist with his arrest. That resulted in him being bitten by the dog, according to the document.
Court documents say there was a permanent protection order in place that prohibited Allen from being at the woman's home and from possessing a weapon. It was issued on Oct. 11, 2023.
He is being held on a $5 million cash or surety bond and is charged with the following:
- Attempted first-degree murder
- Vehicular eluding
- Prohibited use of a weapon – drunk with a gun
- Violation of a protection order
- Two counts of child abuse – negligence
- Driving under the influence
His next court date is set for May 16.
