Denver shooting suspect arrested in Nebraska

DENVER — A man wanted in connection with a shooting in Denver last March was arrested in Nebraska over the weekend. 

The Denver Police Department said in an arrest affidavit that on March 30, 2024, 37-year-old Marvin McCullough was shot at a barbecue hosted by members of the Crips gang at Fuller Park near East 29th Avenue and Gilpin Street.

McCullough was sitting in the driver's seat of a Mercury Cougar when he was shot, the affidavit says. Officers removed him from the car and performed CPR, but he died later at the hospital. Police said he had been shot five times on the right side of his body.

Using tips provided to Metro Denver Crime Stoppers, detectives identified the suspect as 30-year-old Zachary Rice.

The affidavit says McCullough and Rice were both members of the same gang and that they had been feuding for the past year. A witness told police that Rice admitted he had shot McCullough because it was "either me or him," according to the document. 

Rice was arrested after a minor accident on Sunday in Lincoln, Nebraska, where he is being held on a federal probation warrant. The affidavit says when officers confronted him, he initially gave them a false name before giving his real name, explaining that he lied because he "had warrants." He ran when officers tried to arrest him, the affidavit says, but he was taken into custody soon after that.

The affidavit says Rice faces a first-degree murder charge. It's not clear when he will be extradited to Colorado.
