BOULDER COUNTY, Colo. — A grand jury has indicted a man on nine felony counts following a fatal crash that happened in Boulder County earlier this year.
Earl James Garczynski faces several counts of first-degree murder and vehicular homicide.
On May 19, Colorado State Patrol troopers responded to a crash involving four vehicles on Highway 287 near mile post 322. That area is just south of the Larimer-Boulder county line.
According to the indictment, a maroon Dodge Ram 1500 was driving south on Highway 287 and collided with a black Chevrolet Camaro which caused the car to cross the median into the northbound lanes. The Camaro was hit by a Toyota Tundra and bikes fell off the back of the Camaro which hit a Jeep Cherokee, the indictment says.
The driver of the Camaro, Daniel Wright, and his passenger, James Jacobson, were killed in the crash. The driver of the Toyota Tundra suffered serious injuries, according to the indictment.
Troopers determined that the driver of the Dodge Ram pulled over into the highway median to initiate an argument with the driver and passenger of the black Camaro, according to the indictment. Witnesses told troopers that the Camaro returned to the highway and was seen driving normally with traffic. The Dodge Ram was then seen chasing after the Camaro at a speed of about 100 mph, the indictment states.
Witnesses said the driver of the Ram tailgated, brake-checked, swerved and swiped at the Camaro. Further reconstruction of damage to the vehicles showed that the Dodge Ram hit the rear driver's side of the Camaro, causing it to enter northbound lanes of the highway and ultimately crashing into the Toyota Tundra.
The Boulder County Coroner's Office performed autopsies on Wright and Jacobson and determined they died from blunt force trauma, the indictment says.
Garczynski's truck was located on May 23, according to the indictment. Garczynski was called in for a voluntary interview with Colorado State Patrol and denied being involved in the crash, the indictment says. In his initial statement, Garczynski said he saw the Camaro in the median and yelled at them to get off the road as he drove by. Garczynski said he never got out of his truck or was involved in the crash.
When Garczynski was presented with witness statements and video evidence, his story changed many times, troopers said. He eventually admitted to getting out of his truck in the median to yell at the occupants of the Camaro, admitted to driving with the Camaro and seeing the car come across the front of his truck on the highway, the indictment says.
Investigators also talked to a friend of Garczynski who was on the phone with him moments before the crash, police said. The friend told investigators that Garczynski was referencing the Camaro as trying to race him and yelling profanities, the indictment says.
The friend then heard tires screeching, the truck's engine revving and tires rumbling, according to the indictment. Just before hanging up the call, the friend said Garczynski made the statement "that mother f----- won't do that again," the indictment says.
Garczynski is being held in the Boulder County jail under $1 million bond. He's scheduled to be in court Wednesday morning.
