Financial manager will serve no jail time in Vail hit-and-run

VAIL - Financial manager Martin Erzinger pleaded guilty on Thursday evening in connection to a hit-and-run case when he hit a bicyclist from New York City over the summer, but the judge did not give him any jail time.

Erzinger pleaded guilty to careless driving resulting in injury and leaving the scene of an accident resulting in injury. The judge said he has a suspended sentence for the first count as long as Erzinger does charitable duties. Prosecutors were asking for a sentence of 15 months in jail. The judge waived the fine and court costs, but said Erzinger had to donate that amount to charity. For the other count, the judge said Erzinger had to pay the court costs. Police say Erzinger, a wealthy financial manager with Morgan Stanley Smith Barney in Denver, hit bicyclist Dr. Steven Milo with his SUV on July 3. Erzinger had said he fell asleep. "I speak today with a humble heart. The events over the last six months have been traumatic for everyone involved. I am so sorry that this happened," Erzinger said in court on Thursday. Milo had asked that Erzinger be charged with a felony, but the Eagle County District Attorney's office charged him with two misdemeanors instead. District Attorney Mark Hurlbert said the misdemeanor charges could not be sealed from Erzinger's record like the felony charge could be after a few years. "Obviously we're a bit disappointed that the judge did not give some jail time in there, but as the judge said, and I believe him, and it's true, there's not a whole lot we could do in there that would have changed the events of July third and changed Dr. Milo's life," Hurlbert said after the sentencing. Milo only said he was very disappointed as he walked out of court. Erzinger manages more than $1 billion in assets. Certain regulations would require him to disclose a felony charge within a month. Meaning, he could potentially lose his job. Erzinger did lose his driver's license for one year. The district attorney says he likely would have sought the same plea deal if Erzinger worked at Taco Bell. />
